Long Term Disability Claims: The Clients’ Perspective

Have you ever had an injured, ill, or loved one in need, or had to take leave off work for an extended period of time? Every day our organization is faced with persons in difficult situations – whether denied ODSP, CPP, or insurance as part of a Long Term Disability Claim. Our disability insurance lawyers are here to help you.

Every client should try to educate themselves when looking for a long term disability lawyer. Good communication and rapport between lawyer and claimant will ensure a good outcome. Even a well-established lawyer may do irreparable harm if he or she is not extremely sensitive to your needs. Service providers may accidentally make decisions that are not in the best interest of a long term disability insurance claim’s claimant.

Lawyers have an ethical obligation to do their best to conduct themselves “ethically in accordance with high standards of professionalism set out in enforceable rules of conduct” (Federation of Law Societies of Canada) A core function of Canada’s law societies is to set these rules and ensure they are respected through a complaints and discipline process. Your lawyer will be well-advised to make every effort to provide you with the education and support you need to make a rational decision. Even if you have a diminished capacity, your long term disability lawyer will still make his or her best efforts to maintain a normal relationship, such that your disability claim will have merit.

You are the decision-maker

You, as a client, are the ultimate decision-maker in your effort to go through with a long-term disability claim. That’s why we encourage you to read our retainer – of which the Law Society of Upper Canada (LSUC) has received with praise. Be aware:

  • Double-dipping is a practice we do not condone: Read More
  • “A contingency fee agreement shall not include in the fee payable to the solicitor … any amount arising as a result of an award of costs or costs obtained as part of a settlement.” — Solicitors Act of Ontario

You can leave at any time.

We have seen cases where many clients will fire their long term disability lawyer for the poor performance in a disability insurance claim. Without good communication, a working relationship can quickly degrade. As a client, you must find the right lawyer – one who will represent your best interests and values. A good lawyer will communicate with you in your preferred method of communication – whether written, in-person, through one of your representatives, via phone, etc.

Lawyers may also commit to providing you with documents in your preferred modus operandi; for instance if you would rather have type-written materials, converting print materials to audio, using larger fonts, braille, and other such methods. Again, your lawyer is here to cater to your needs and should not discriminate.

If you have a cognitive disorder, you may require special accommodations, but your long term disability lawyer may need to take special precautions and actions in order to represent you better. You may also opt to have a friend or family member liaise with the lawyer if you feel that you are not up to the task.

Regardless of your encumbrances, if your long term disability claim has been denied, or you feel that you or a loved one have been wrongfully denied long-term disability, then we highly suggest you contact a long term disability lawyer..
